New Jersey Prenuptial Agreement
This Prenuptial Agreement ("Agreement") is made on ________ (the "Effective Date"), by and between _________________ ("Party One") and _________________ ("Party Two"). Both parties are collectively referred to herein as the "Parties."
WHEREAS, the Parties intend to marry under the laws of the State of New Jersey, and
WHEREAS, the Parties wish to establish their respective rights and obligations regarding each individual's current and future property, whether owned or acquired individually, jointly, or separately by either Party and
WHEREAS, the Parties have disclosed to each other their current financial status, including assets, liabilities, income, and expectations of gifts, inheritances, or other acquisitions,
NOW, THEREFORE, in consideration of the marriage and mutual covenants and agreements made herein, the Parties agree as follows:
- Financial Disclosure. Each Party has fully and completely disclosed to the other Party their current financial status, including but not limited to assets, debts, income, and expectations of inheritance or gifts.
- Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey, without giving effect to any choice of law or conflict of law provisions.
- Property Rights. The Parties agree to waive and release any and all rights to the other's property that may accrue by virtue of their marriage, except as otherwise specified in this Agreement or under the laws of the State of New Jersey.
- Amendments and Modifications. Any amendments or modifications to this Agreement must be in writing and signed by both Parties to be effective.
- Separation of Property. The Parties agree that any property, whether tangible or intangible, acquired by either Party before the marriage shall remain the sole and separate property of that Party. Likewise, property acquired by either Party during the marriage through inheritance, gift, or personal effort without the other's contribution shall also remain the separate property of the acquiring Party.
- Joint Property. Any property acquired jointly by the Parties during the marriage shall be divided according to the contribution of each Party unless otherwise agreed upon in writing.
- Spousal Support. The Parties may agree on provisions for support of either Party during or after dissolution of the marriage, subject to the approval of the appropriate New Jersey court.
- Severability. If any provision of this Agreement is deemed invalid or unenforceable, that provision will be severed from the Agreement and the remaining provisions shall remain in full force and effect.
- Entire Agreement. This document represents the entire agreement between the Parties and supersedes any prior discussions, agreements, or understandings of any kind.
- Voluntary Execution of Agreement. Each Party confirms that they have entered into this Agreement voluntarily, without any coercion or undue influence, and fully understand its terms and consequences.
